The Family First: Family Focused Estate Plans

Few things are as universal as a parent’s desire to protect and provide for their family. But what if you suddenly died or became incapacitated? A Family First Estate Plan will reduce the chaos of a sudden tragedy and decrease potential conflicts that can arise among family members during an emotional and stressful time. Ask yourself the following questions: Do you want your family fighting over your possessions? Who would have custody of your minor children? Does your child have special needs that must be met? Do you have children from a previous marriage? How would property be held and controlled for a minor? Would a sudden large sum of money given to your child be a blessing or a curse? Family First Estate Plans focus on addressing these concerns by creating clear plans for the benefit and protection of your family when you are no longer able to physically provide that protection yourself.

One mission of ARK Law is to create peace of mind for public safety members so they can focus on the task at hand. Whether you are serving a warrant or fighting a fire, the thought of what would happen to your family if something went wrong should not be a concern. Unfortunately, the high risk of incapacitation, high divorce rates, and blended family situations create unique family scenarios. These unique scenarios require specific planning to ensure your wishes are known and respected. As a Military Veteran of the United States Navy, ARK Law Attorney Christopher Torres is passionate about protecting the livelihoods of those who continue to serve and protect our communities.

The Estate Plan Check-Up

An Estate Plan is not a “set it and forget it” plan. As your life changes, so should your estate plan. You should be reviewing your estate every 3 to 5 years. The review may reveal a need to update your will or trust. We can draft valid supplements and trust amendments that address changes in your financial situation, marital status, number of children, philanthropic interests and general lifestyle decisions.

Estate Planning Resources

What is a living trust?

A living trust is a legal document that dictates who you wish to manage and distribute your assests if you become unable to do so. Additionally, it allows you state who receives your assests when you eventually pass away. Once a living trust is establised, ownership of your assets is transfered to the trust but you remain in control of those assets. Assets in the trust can then be managed and distributed without the need and avoiding the costs associated with the probate court process.

The Cost of Probate In CA?
